Refund and Subscription Cancellation Policy of the edubba Platform

Annex No. 2 to the Terms of Service of the edubba Platform
This document (hereinafter: the "Refund Policy") defines the detailed rules for refunds, resignations, and subscription cancellations within the framework of using the edubba educational platform, available at www.edubba.ai (hereinafter: the "Platform"). This Policy constitutes an integral part of the Terms of Service provided by the Service Provider – IBIS Świderski Sp. K.
§ 1. Nature of Digital Services and the Right to Withdraw
- Services provided via the edubba.ai Platform constitute digital services delivered under a subscription model (SaaS).
- A User who is a Consumer or a Sole Trader with Consumer Rights (PNPK) has the right to withdraw from the agreement for the provision of digital services within 14 days from the day of its conclusion without giving a reason, subject to the provisions of paragraphs 3 and 4 of this section.
- Loss of the right to withdraw: If, at the express request of the User, the performance of the service (making the AI functionalities available) has begun before the expiry of the 14-day withdrawal period, the User loses the right to withdraw from the agreement from the moment of actual commencement of using the AI generator (which occurs at the moment of clicking the button generating didactic materials based on the entered data).
- In the case referred to in paragraph 3, upon the execution of the first content generation operation by the AI, the performance is deemed fully completed within the meaning of Art. 38(1)(13) of the Consumer Rights Act, and a refund for the given billing period shall not be granted.
- Withdrawal Button: In order to facilitate the exercise of consumer rights, an explicit, easily visible "Withdraw from agreement" button is available in the User panel after logging in (under the "Payments / Subscription" tab) and in the footer of the homepage. Clicking the button and filling out a simple digital form results in the immediate and automatic registration of the statement of withdrawal, of which the User will be immediately notified via e-mail on a durable medium.
- Institutional Users (Schools, educational institutions, and B2B entities) are not consumers, and they are not entitled to the statutory right to withdraw from the agreement within 14 days without giving a reason.
- The non-use of an active subscription by the User (lack of system logins, lack of actual content generation) during the paid billing period does not constitute a ground for demanding a refund of funds, as the Service Provider continuously incurs costs related to the full readiness of the technical infrastructure to provide services to that User.
§ 2. Exceptions and Situations Justifying a Refund
The Service Provider allows for the possibility of granting a full or proportional refund of the subscription fee uniquely in the following strictly defined scenarios:
- Technical issues: The occurrence of critical system errors on the Platform's side (e.g., long-term, complete failure of edubba servers) that prevented the User from using the paid service for a total period exceeding 48 business hours. This exception does not include technical breaks announced by the Service Provider or failures of independent external providers (e.g., global interruptions in the provision of API services by OpenAI).
- Incorrect or duplicate payments: Situations in which the payment operator (Stripe), due to a technical error, debited funds for the same subscription twice, or an obvious system error occurred during transaction processing.
- Unintentional renewal of an annual subscription: In the case of annual plans for Consumers and PNPK, if the User did not cancel the subscription before its expiry and an automatic charge was made for the next year, a refund is possible, provided that this fact is reported via the withdrawal button or by e-mail within 14 days from the date of the charge (in accordance with the statutory period for continuous services) and provided that no AI function has been used in the new billing period. This provision does not apply to Institutional Users (Schools), for whom the rules for subscription renewal and cancellation result directly from the selected plan in the Platform's panel and are subject to the general cancellation terms specified in these Terms and Conditions.
§ 3. Subscription Cancellation Procedure
- The User may cancel the further extension and renewal of the subscription at any moment.
- Subscription cancellation can be performed independently from the profile settings in the edubba Platform panel (under the "Subscription" / "Payments" tab), by using the "Withdraw from agreement" button, or by sending an explicit cancellation request via e-mail to: contact@edubba.ai.
- After cancelling the subscription, the system will not charge a fee for the next billing period (monthly or annual).
- Access until the end of the term: Following cancellation, the User's account and all AI functionalities remain fully active until the last day of the currently paid billing period. The Service Provider does not refund funds for unused days in a given billing period if the User decided to click the cancellation option earlier.
§ 4. Account Status after Subscription Expiry (Inactive Account)
- Upon the official expiry of the paid subscription period and in the absence of its renewal, the Account of an Individual User is not deleted but automatically transitions into a free, inactive state.
- In the inactive state, the User retains access to their Account, profile, and billing invoices, and their accumulated Source Materials and Generated Materials are securely stored in the system, enabling a seamless reactivation of the subscription in the future without data loss.
- In the inactive state, all functionalities based on artificial intelligence (AI), the generation of new materials, and advanced curriculum analyses are blocked until the selected subscription plan is paid for again.
- The data of Individual Users are permanently deleted solely at their express request (in accordance with Section 13 of the Privacy Policy).
- The provisions of paragraphs 1–3 do not apply to Institutional Users (Schools). In the case of the expiry of an organizational subscription, edubba does not maintain the Account in an inactive state, and the procedure, return, and absolute time limits for the complete deletion of student and teacher data are regulated exclusively by § 8 of the DPA Agreement (Annex No. 1).
§ 5. Submission of Refund Requests (Complaint Procedure)
- All requests for refunds in the cases specified in § 2 must be submitted via the digital form linked to the "Withdraw from agreement" button or directly via electronic mail to the e-mail address: contact@edubba.ai.
- The submission should include: the e-mail address associated with the Account on the Platform, transaction confirmation / payment identifier from the Stripe system, and a concise reason for requesting a refund (e.g., description and duration of the technical error).
- The request shall be considered by the Service Provider within 14 days from the date of its receipt.
- In the event of a positive consideration of the request, the funds shall be returned to the User using the same payment method that was used to pay for the subscription. The Service Provider initiates the refund in the Stripe system immediately; however, the final time for the funds to be credited to the User's account depends on the payment operator and the User's banking institution.
